Personal Data Processing

1.1. User Information

Who is responsible for processing your personal data?

Cerberu Telegestión Turística S.L. is the RESPONSIBLE for processing the USER's personal data and informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD).

For what purpose do we process your personal data?

To maintain a commercial relationship with the user. The operations foreseen for the processing are: Sending commercial advertising communications by e-mail, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by the RESPONSIBLE and will be related to its products and services, or those of its collaborators or suppliers, with whom it has reached a promotion agreement. In this case, third parties will never have access to personal data.

  • Conduct market studies and statistical analyses.
  • Process orders, requests, respond to inquiries, or any type of request made by the USER through any of the contact methods available on the RESPONSIBLE's website.

Send the online newsletter, with news, offers, and promotions in our activity.

Why can we process your personal data?

Because the processing is legitimized by Article 6 of the GDPR as follows:

With the USER's consent: sending commercial communications and the newsletter.

By the RESPONSIBLE's legitimate interest: conducting market studies, statistical analyses, etc., and processing orders, requests, etc., at the USER's request.

For how long will we keep your personal data?

They will be retained for no longer than necessary to maintain the purpose of the processing or there are legal prescriptions that dictate their custody, and when they are no longer necessary for that purpose, they will be deleted with appropriate security measures to ensure the anonymization of the data or their total destruction.

To whom do we provide your personal data?

No communication of personal data to third parties is foreseen unless it is necessary for the development and execution of the purposes of the processing, to our communication service providers, with whom the RESPONSIBLE has signed the confidentiality and data processor contracts required by the current privacy regulations.

What are your rights?

The rights that assist the USER are:

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability, and deletion of your data, and of limitation or opposition to their processing.
  • Right to file a complaint with the control authority (www.aepd.es) if you consider that the processing does not comply with the current regulations.

1.2. Obligatory or Optional Nature of the Information Provided by the User

USERS, by marking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly, freely, and unequivocally accept that their data is necessary to attend to their request, by the provider, being voluntary the inclusion of data in the remaining fields. The USER guarantees that the personal data provided to the RESPONSIBLE are truthful and is responsible for communicating any modification thereof.

The RESPONSIBLE informs that all data requested through the website are mandatory, as they are necessary to provide an optimal service to the USER. In the event that not all data is provided, it is not guaranteed that the information and services provided will be completely adjusted to your needs.

1.3. Security Measures

In accordance with the provisions of the current regulations on personal data protection, the RESPONSIBLE is complying with all the provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR, by which they are processed lawfully, fairly, and transparently in relation to the data subject and adequately, relevantly, and limited to what is necessary in relation to the purposes for which they are processed.

The RESPONSIBLE ensures that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD to protect the rights and freedoms of USERS and has communicated the appropriate information so that they can exercise them. Privacy and Social Media Policy

2.1. User Information

Who is responsible for processing your personal data?

Cerberu Telegestión Turística S.L, henceforth RESPONSIBLE, informs the USER that it has proceeded to create a profile on the Social Networks Facebook, Instagram, Twitter, LinkedIn, Youtube, Vimeo, and Google+, which is responsible for processing the user's personal data that is carried out on these social networks and informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD), providing the following information on the processing:

For what purpose do we process your personal data?

Purpose of the processing: to maintain a relationship between the USER and the RESPONSIBLE, which may include the following operations:

  • Process requests and inquiries made to the responsible party
  • Inform about activities and events organized by the responsible party
  • Inform about products or services offered by the responsible party.
  • Interact through official profiles.

Why can we process your personal data?

Legal basis for the processing: Article 6.1.a GDPR, the data subject has given their consent for the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the RESPONSIBLE's social network, showing interest in the information published on it, therefore, at the time of requesting to follow our official profiles, the USER provides their consent for the processing of those personal data published on their profile.

The USER can access the privacy policies of the same social network at any time, as well as configure their profile to guarantee their privacy. The RESPONSIBLE has access and processes the USER's public information, especially their contact name.

These data are only used within the same social network and will only be incorporated into a file of the RESPONSIBLE when necessary to process the USER's request.

For how long will we keep your personal data?

Criteria for data retention: they will be retained as long as the USER does not revoke the consent provided as indicated in this privacy policy.

To whom do we provide your personal data?

Communication of the data: the information provided by the USER through the RESPONSIBLE's social networks, including their personal data, may be published, always depending on the services the USER uses, so it may be made public to other third-party users of the social networks. From the profile of each social network, the USER can configure which information they want to make public in each case, see the permissions granted, remove them or deactivate them, as any third-party application that is no longer desired to be used.

No communication of personal data to third parties outside the social network is foreseen unless it is essential for the development and execution of the purposes of the processing, to our communication service providers, with whom the RESPONSIBLE has signed the confidentiality and data processor contracts required by the current privacy regulations.

What are your rights?

Rights that assist the USER: only those related to the information under the control of the RESPONSIBLE can be satisfied.

2.2 Use of the Profile

The RESPONSIBLE will perform the following actions:

Access to the public information of the profile.

Publication on the USER's profile of all the information already published on the RESPONSIBLE's social network.

Send personal and individual messages through the social network channels.

Updates of the page status that will be published on the USER's profile.

The USER can always control their connections, delete content that no longer interests them, and restrict who they share their connections with; to do this, they must access their privacy settings.

2.3 Publications

The USER, once a follower or joined the RESPONSIBLE's social network, can publish comments, links, images, photographs, or any other type of multimedia content supported by it. The USER, in all cases, must be the owner of the published content, enjoy copyright and intellectual property rights, or have the consent of the affected third parties.

It is expressly prohibited to publish any content on the social network, whether texts, graphics, photographs, videos, etc., that attack or are likely to attack morality, ethics, good taste, or decorum, and/or that infringe, violate, or breach intellectual or industrial property rights, the right to image, or the Law. In these cases, the RESPONSIBLE reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The RESPONSIBLE will not be responsible for the content that a USER has freely published.

The USER must bear in mind that their publications will be known by other users, so they themselves are the main responsible for their privacy. The images that may be published on the social network will not be stored in any file by the RESPONSIBLE, but they will remain on the social network.

2.4 Data of Minors or Persons with Special Capacities

Access and registration through the RESPONSIBLE's social networks is prohibited for minors under 18 years of age. On the other hand, if the USER has special capacities, the intervention of the holder of their guardianship or custody, or their legal representative through a valid document attesting to their representation, will be necessary.

The RESPONSIBLE will be expressly exempted from any responsibility that could arise from the use of social networks by minors or persons with special capacities. The RESPONSIBLE's social networks do not consciously collect any personal information from minors, therefore, if the USER is a minor, they should not register, use the RESPONSIBLE's social networks, nor provide any personal information.
